Title VI Complaint Procedures

As a recipient of federal dollars, The Arc Fresno/Madera Counties is required to comply with Title VI of the Civil Rights Act of 1964 and ensure that services and benefits are provided on a non-discriminatory basis. The Arc Fresno/Madera Counties has in place a Title VI Complaint Procedure, which outlines a process for local disposition of Title VI complaints and is consistent with guidelines found in the Federal Transit Administration Circular 4702.1B, dated October 1, 2012.

Any person who believe she or he has been discriminated against on the basis of race, color, or national origin by The Arc Fresno/Madera Counties may file a Title VI complaint by completing and submitting the agency’s Title VI Complaint Form.  The Arc Fresno/Madera Counties provides for following procedure for individuals filing a grievance and will not tolerate retaliation of any kind when a grievance or complaint is filed.

The following is the process for filing a grievance:

  1. Meet with your training Supervisor or Case Manager and tell them that you wish to have a grievance form and file your grievance. They will help you fill the form out.
  2. A meeting will happen with your case manager to discuss your concern(s) within 24 hours of filing your grievance.  Hopefully, at this time your concern shall be fixed.
  3. If you feel your concern is still not fixed, the Program Manager will meet you within 2 working days after the first meeting.   If the Manager’s decision is not satisfactory, the following procedures shall be followed:
  4. Within five (5) working days of the incident, an appeal of the decision shall be given to the appropriate Case Manager.
  5. If a solution can not be reached within five (5) working days after the meeting with the Program Manager, a written request for a review with the Director of Program Services shall be the next level of appeal, this will take place no longer than 10 days after the incident.  Your Case Manager shall assist you as necessary.
  6. If a solution is still not reached, the appeal will be sent to the Executive Director for a final consideration no greater than 15 days after the incident.
  7. You shall be informed both verbally and in writing of the appeal decision and all phases of the appeal within five (5) working days after the meeting.
  8. If after receiving the Executive Director’s final solution you would like another agency to review your concern you may contact the Area 8 Board (770 E. Shaw Ave., Suite 123, Fresno, CA. 93710, (559) 222-2496, Fax: (559) 248-2886, ab8@scdd.ca.gov) or ask your Case Manager to help you contact them with your concern.
